Prenuptial Agreements

We can provide expert advice to help you prepare a formal agreement that sets out what would happen in the event of the marriage breaking down and what should happen to assets owned prior to marriage and accrued during the marriage. These agreements are not binding upon the Court. However, the court in the landmark decision in Radmacher v Granatino gave ‘decisive weight’ to prenuptial agreements

In a nutshell a prenuptial agreement is more likely to be upheld if the following apply.

  • Did both parties receive legal advice
  • Was any pressure brought to bear or did the prenuptial agreement follow negotiation, preferably by lawyers, or was the prenuptial agreement imposed by one party on the other.
  • What was the timeframe between signing the prenuptial agreement and the wedding,
  • Was there full and frank financial disclosure.
