Prenuptial Agreements

These agreements are not binding upon the Court. However, the court in the landmark decision in Radmacher v Granatino gave ‘decisive weight’ to prenuptial agreements

In a nutshell a prenuptial agreement is more likely to be upheld if the following apply.

  • Did both parties receive legal advice
  • Was any pressure brought to bear or did the prenuptial agreement follow negotiation, preferably by lawyers, or was the prenuptial agreement imposed by one party on the other.
  • What was the timeframe between signing the prenuptial agreement and the wedding,
  • Was there full and frank financial disclosure.
